The Constitution of the Republic of South Africa, 1996 is the most important law in our country. The Bill of Rights, which is included in our constitution, protects individual human rights of persons and, as a consequence, the rights of arrested or accused person.
The Constitution guarantees the following rights.

If arrested the right to remain silent.
If detained the right to be informed of the reason for being detained and to consult your legal representative (attorney) and the right to be informed of this rights promptly.
At the first court appearance after being arrested to be charged and or to be informed of the reason of detention or to be released from detention if the interest of justice permits. ( being released by means of bail, warning in terms of the Criminal Procedure Act 51 of 1977)
And the right to fair trial which include the right to a public trial before and ordinary court, to be represented by a legal practitioner and to be informed of this rights promptly.
